1. General
Conclusion of the contract and resulting services are performed solely on the basis of these T&Cs. Any changes must be made in writing.
2. Quotations
Quotations created are valid for seven days and only in their original format, verbal commitments are not valid. Any extended periods of liability must be documented. The cost estimate on which the quotation is based is supplied without guarantee.
3. Services
The quotation sets out the scope of services and is executed by Next2Sun or third parties. Any unforeseen services or additional costs not included in the quotation will be covered by the client.
4. Payment terms
All prices are inclusive of the applicable statutory value-added tax. Payment terms: 80% deposit and 20% upon commissioning. The goods remain our property until payment is received in full. In the event of withdrawal from the contract before implementation/installation work, a cancellation fee of 10% of the total order amount will be due. We reserve the right to claim a higher fee (for example due to material purchases already made). In the event of a later withdrawal, Next2Sun is entitled to demand the agreed payment as per section 1168 of the General Civil Code (ABGB). The price of PV modules may vary. If other payment terms apply, these must be set out in writing.
5. Installation and delivery services – requirements
Once the goods have been delivered, they must be stored in a locked location, for which liability lies with the customer.
6. Delivery deadlines
Dates and deadlines are only deemed to be binding if they are agreed in writing. No indemnity claims resulting from delays in delivery will be accepted.
7. Retention of title
The goods remain the property of Next2Sun until payment is received in full. In the event of default of payment or other breaches of duty by the client, we reserve the right to withdraw from the contract. Disassembly and delivery costs shall be borne by the client.
8. Warranty
Statutory warranty rights apply. Next2Sun AG offers no guarantee beyond proprietary components and associated warranty conditions. Warranties for individual components (modules, inverters, storage etc.) are based on the relevant manufacturer’s conditions, where the manufacturer is the responsible party (manufacturer warranty).
9. Withdrawal
Either party may exercise their statutory right of withdrawal.
10. Claims for damages
Next2Sun is not liable for material damage caused by slight negligence. Next2Sun shall also not be liable to contractual partners who are not consumers under the Consumer Protection Act (KSchG) for material damage caused by simple gross negligence.
11. Advertising
The client agrees to Next2Sun publishing photos and images of the system for advertising purposes.
12. Electrical energy feed-in
Feeding electrical energy into the grid requires a contract between the public grid operator and the client, which must be concluded by the client.
13. Final provisions
There are no additional verbal agreements.
